RIGHT OF WITHDRAWAL
The Consumer who purchases products and services directly from the website www.albachiara.fashion, has the right to withdraw from the contract as provided for in the new directive 2011/83/EU, implemented by Legislative Decree 21 February 2014, n. 21. The Consumer customer can return the products or renounce the services purchased within 14 days from the delivery of the product or from the purchase of the service and obtain a refund of the price already paid, without having to provide any reason and without incurring any cost, except for the direct cost of returning the goods to albachiara Srl The Consumer is also responsible for the risks associated with transport operations for returning the product. The right of withdrawal is exercised by sending, within 14 days following the delivery of the product or the purchase of the service, a written communication to the headquarters of albachiara Srl, in San Lazzaro di Savena (BO), Via Salvo D'Acquisto n. 1, chap. 40068 by registered letter with acknowledgment of receipt. The communication can be sent, within the same term, also by telegram, telex, e-mail and fax, provided that it is confirmed by registered letter with acknowledgment of receipt within the following forty-eight hours; the registered letter is considered sent in good time if delivered to the accepting post office within the terms indicated above. The acknowledgment of receipt is not, however, an essential condition for proving the exercise of the right of withdrawal. The right of withdrawal lapses when the returned product is not intact, has no original packaging or has suffered transport damage not attributable to the delivery made by albachiara S.r.l. to the Consumer and not previously reported. The refund of the price paid by the consumer will be made by albachiara S.r.l. within 14 days from the date of receipt of the communication of withdrawal by the consumer. The refund will be made by bank transfer to the coordinates indicated by the consumer in the communication of withdrawal. The consumer must return the goods within 14 days from the date on which he communicated to albachiara S.r.l. the will to withdraw from the contract. This term is considered respected if the consumer returns the goods to albachiara S.r.l. before the expiration of the above 14-day period.
